Eligibility

The McIntosh County Bank Survey promotion (the “Promotion”) is open only to legal residents of the fifty (50) United States, the District of Columbia, Puerto Rico, and territories and possessions of the United States who are at least eighteen (18) years old at the time of entry. Employees of McIntosh Count Bank as well as household members (including spouses and children) of the employees are not eligible to participate in the Promotion. The Promotion is subject to all applicable federal, state, and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. The complete award is contingent upon fulfilling all requirements set forth herein.

Timing

The Promotion begins on July 14, 2014 and ends on September 14, 2014. (the “Promotion Period”). For the purposes of these Official Rules, a “day” will run from 12:00:01 a.m. CST to 11:59:59 p.m. CST each day of the Promotion Period.  The Sponsor’s designated computer is the official time-keeping device for the Promotion.
How to Enter
There is one (1) way to enter the Promotion:
McIntosh County Bank Website: During the Promotion Period, visit the McIntosh County Bank website at https://www.makeitmcb.com and click on the Survey Banner on the homepage or click on the Survey ad in the middle left of the page.  Complete the information requested.  Once you click the Submit button, you are automatically registered.

Limit
You may enter one (1) time during the Promotion Period. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number entries by using multiple/different email addresses, identities, registrations, and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the entrant. The authorized account holder is defined as the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.

Grand Prize Drawing

The Sponsor, McIntosh County Bank, is the administrator. The decisions as to the administration and operation of the Promotion and the selection of the potential winners are final and binding in all matters related to the Promotion.  The administrator will randomly select the three potential Promotion Grand Prize winners from all eligible entries received during the Promotion Period, on or around August 11, 2014. The potential winners will be notified by email and/or telephone.  Except where prohibited, the potential winners (or parent/legal guardian if winner is a minor in his/her state of residence) will be required to sign and return a Declaration of Compliance, Liability and Publicity Release (“Declaration”) which must be received by Administrator, within two (2) business days of the date notice or attempted notice is sent, in order to claim the prize. If a potential winner of the award cannot be contacted, fails to sign and return the Declaration within the required time period, or the award is returned as undeliverable, the potential winner forfeits the award. Receiving an award is contingent upon compliance with these Official Rules. In the event that the potential winner is disqualified for any reason, Sponsor will provide award to an alternate winner by random drawing from among all remaining eligible entries. Up to three (3) alternate selections will be held, time permitting, after which the award will remain un-awarded.

Award

THREE (3) GRAND PRIZES: $50.00 cash. Any differences between the actual value of the award and the approximate retail value set forth in these Official Rules may not be claimed and will not be awarded. Award is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the award for one of equal or greater value if the designated award should become unavailable for any reason. All taxes or expenses, including, without limitation, expenses associated with the award not specified herein as part of the award, sales tax, luxury tax, and any other costs incurred in claiming or using any of the award, are the sole responsibility of the award winner. Entrant agrees to provide to Sponsor with winner’s name, address and tax identification number for IRS 1099-MISC reporting.  Odds of winning the award depend on the number of eligible entries received during the Promotion Period. In order to receive the Award, the winner must execute and comply with the Declaration of Compliance and Release.

Release

By entering, entrant agrees to release and hold harmless Sponsor, Administrator, and their respective  affiliates,  advertising/promotion agencies and award suppliers, and each of their respective officers, directors, employees and agents (collectively, the “Released Parties”) from  and against any claim, loss, liability, cost or expense (including reasonable attorney's fees and court costs) arising out of participation in the Promotion or receipt or misuse of any items awarded, including, but not limited to, personal injury, death, tax liability, or damage to or loss of property. Acceptance of award shall constitute and signify the winner’s agreement and understanding that the Released Parties have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to any award item, including but not limited to its quality, merchantability, fitness for a particular purpose or mechanical condition.

Publicity

Except where prohibited, participation in the Promotion constitutes the winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

General Conditions

Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Limitations of Liability

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any award item. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion, if it is possible. If the Promotion, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the award items offered herein. No more than the stated number of items will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of award items as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of items by a random drawing among all legitimate, un-awarded, eligible prize claims.

Disputes

Except where prohibited, entrant and Sponsor: (1) agree that any and all disputes, claims and causes of actions arising out of or connected with these Official Rules, the Promotion or any item awarded in connection with the Promotion ("Dispute") shall be resolved individually, without resort to any form of class action, and hereby waive any right to participate as a class representative or class member in any class action suit, (2) submit to the exclusive jurisdiction of any federal or state court sitting in McIntosh County, North Dakota for the purpose of any Dispute, (3) irrevocably waive, to the fullest extent possible, the defense of an inconvenient forum to the maintenance of any Dispute, (4) Sponsor shall not be liable for any special, indirect or consequential damages, even if Sponsor has been advised of the possibility of those damages, (5) any and all claims, judgments and awards in connection with any Dispute shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, in connection with these Official Rules and the Promotion. These Official Rules, the Promotion, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, and the rights and obligations of the entrant and Sponsor in connection with these Official Rules and the Promotion, shall be governed by, and construed in accordance with, the laws of the State of North Dakota without giving effect to any choice of law or conflict of law rules (whether of the State of North Dakota or any other jurisdiction), which would cause the application of the laws any jurisdiction other than the State of North Dakota.
